Dish Network Corp., along with its sister company EchoStar Corp. was ordered by a federal court to pay some $200 million to TiVo Inc. after being found “guilty” of violating a permanent injunction over a modified technology that will viewers to pause and rewind Live TV.
In his decision, US District Court Judge David Folsom of Texas has ordered Dish to pay TiVo, the maker of the popular DVR device, a sum of $200 million for violating an injunction imposed earlier by the court.
The award will cover $110 million for damages to TiVo and another $90 million for sanction fines, which includes the attorney fees.
The judge, in his order, said that Dish and EchoStar would face an even higher sanction award should it lose on the case, which was under an appeal.
The case stemmed from an alleged violation committed by Dish against TiVo for its DVR technology. But while the case was still on going, the company has released modified software much like the DVR and downloaded it to costumer’s device.
TiVo then filed for a permanent injunction at a federal court, saying that Dish has created software that only workaround on the DVR technology.
TiVo executives said that the technology was still infringed, which the court sided early in June.
The court then slapped Dish with a permanent injunction to stop it from further selling the technology.
It will be recalled that Dish was asked by TiVo to pay $1 billion for continues use of the modified DVR technology since April 2008 up to July 2009.
For their part, Dish said that the injunctions imposed against them by the court were not warranted, saying that it was too early to say that they have violated the infringement act.
They added that if the court rules against TiVo’s $1 billion award, then the injunction violation was not willful.
“The court’s decision was a confirmation of our belief that we have not infringed any technology owned by TiVo and that we designed around the technology patent in good faith. We will prevail in this appeal and would continue to do business,” Dish said in a statement released on Friday.
